The Constitutional Court has declared the Public Procurement Act unconstitutional and invalid, finding that Parliament failed to fulfil its constitutional obligation to facilitate reasonable public participation in the law-making process. AmaBhungane was directly involved in the litigation as a second applicant in the Constitutional Court case, after intervening in the challenge brought by the Western Cape Premier and the City of Cape Town. The Constitutional Court ultimately found that Parliament had failed to reasonably facilitate public involvement and, as a result, declared the Act unconstitutional and invalid. So tonight, we’re going to unpack the case from the perspective of one of the organisations that brought the challenge before the Court.
