The African Commission on Human and Peoples' Rights (ACHPR), an organ of the African Union responsible for promoting and protecting human rights across the continent, has dismissed former Public Protector Busisiwe Mkhwebane's complaint challenging the fairness of her impeachment process.
Mkhwebane argued that the parliamentary process leading to her removal from office violated her rights under the African Charter on Human and Peoples' Rights, including her right to a fair hearing and due process.
However, the Commission found that South Africa's constitutional and legal framework provides adequate safeguards to ensure a fair impeachment process. It concluded that Parliament's procedures, together with the availability of judicial review through South African courts, met the standards required under the African Charter. The ruling reinforces confidence in South Africa's constitutional institutions while highlighting the importance of accountability for holders of public office.
