“Love, Lobola & the Law – Adv. Sibuya Breaks Down the Black Coffee Divorce Ruling”

Loading player...
n this episode, we’re joined by Advocate Sibuya, who helps us unpack the legal and cultural layers behind the headline-making Black Coffee and Enhle Mbali divorce case.

The court ruled that the couple’s antenuptial contract (ANC) — signed years after lobola had been paid — was invalid, meaning their marriage was legally in community of property. As a result, DJ Black Coffee has been ordered to pay spousal maintenance to his ex-wife, Enhle Mbali Mlotshwa.

Together with Adv. Sibuya, we explore key questions many South Africans are asking:

If lobola is paid before an antenuptial contract is signed, should the law automatically treat that marriage as in community of property?

What does this ruling mean for couples who combine customary and civil marriage traditions?

And — is this judgment fair to both parties?

This conversation with Adv. Sibuya sheds light on a landmark ruling that could redefine how South Africans approach love, marriage, and the law.
